Tbilisi. On November
22, Green Alternative has addressed the Chief Prosecutor’s Office of Georgia
with an application, requesting the investigation of offences in relation to
the construction of 110 megawatt hydro-electric power on the river Tergi in the
Kazbegi Municipality.

Alternative alleges that both the company and the state agencies have grossly
violated the requirements of law. In particular:
The company "Dariali Energy” was
constructing the power station for several months without a due permit, while
the Ministry of Environmental Protection and the Ministry of Energy and Natural
Resources have not taken any measures to prevent this violation.
The Ministry of Environmental Protection has grossly violated the
requirement of law by issuing the positive ecological expert opinion on the
construction project of the "DarialiHEP”, which included the construction
activities in the territory of the Kazbegi National Park.
To remedy the illegality approved by
the order of the Minister of Environmental Protection of Georgia, with gross
violation of the law the Parliament of Georgia has amended the Law of Georgia
on the Status of Protected Territories and excluded the territory of over 20
hectares from the Kazbegi National Park by referring to the construction of the
HEP.

Alternative request the Chief Prosecutor of Georgia to probe into the offences
committed by the respective officials of the Parliament of Georgia, the
Ministry of Environmental Protection and the Ministry of Energy and Natural
Resources in relation to the construction/allocation of the "DarialiHEP” and to
apply the measures foreseen under the criminal legislation.
