The Promoting Rule of Law in Georgia (PROLoG) Activity is a United States Agency for International Development (USAID) funded project designed to strengthen the justice system to ensure due process, judicial independence, and the protection of human rights. PROLoG has determined that strengthening continuing legal education (CLE) programs can make an important contribution to improving the capacity of legal professionals to advocate for and protect human rights in Georgia. PROLoG is accordingly supporting the efforts of the Georgian Bar Association (GBA) to develop model CLE courses on human rights-related subjects. The 2016 CRRC study on judicial system in Georgia revealed that most legal professionals believe that the civil and administrative law and practice enables a fair balance between parties. Yet, over one-fifth of the lawyers questioned stated that neither administrative law nor administrative practice fully provides equality of arms or preserves due process rights. Thus, CLE for lawyers on fair trial and access to justice in administrative proceedings is needed for lawyers to develop the knowledge and skills necessary to protect their clients' interests effectively. This need is intensified by the fact that, as reported by GBA, since the establishment of GBA CLE program there has been no course on access to justice and administrative procedure developed for GBA members.
Proposed Approach
Program Outline:
PROLoG will hire an Expert (the Expert) to develop a model course for a GBA CLE program on fair trial and access to justice in administrative proceedings (the Course). The Course will provide GBA members with the necessary understanding/knowledge of administrative proceedings and related human rights components to enable them to properly identify remedies against injustice and effectively protect the rights of their clients. Working closely with PROLoG, the Expert will first develop an outline for the course. After receiving PROLoG approval of the outline, the Expert will engage in legal research on relevant jurisprudence and draft the course curriculum and course materials under the supervision of PROLoG staff. The Expert will next help PROLoG and the GBA deliver this course to a group of GBA trainers in a Training of Trainers format (ToT).
